Xmodhub Game Modifier License and Service Agreement

This agreement is concluded between you and Larvas Limited, the XMODhub game modifier service provider, and this agreement has contractual effect. Please read all the terms of this agreement in detail. If you agree to this agreement, you can continue to use the services provided by XMODhub Game Modifier. If you click Agree, Accept or Next, or if you register or use the XMODhub game modifier, you will be deemed to have read and agreed to sign this agreement. If you are under 18 years old, please read this agreement accompanied by a legal guardian and obtain the consent of the legal guardian before you can use the XMODhub game modifier service. At the same time, you should pay special attention to the terms of use for minors.

1. [Definition]

1.1 This Agreement: refers to the text of this Agreement, user rules, "XMODhub Game Modifier Privacy Protection Guidelines" and its revised versions. Once the above content is officially released, it will become an integral part of this agreement.

1.2 User Rules: Refers to the announcements, tips and notices regarding XMODhub game modifiers published and revised by XMODhub from time to time.

1.3 XMODhub game modifier service provider: Larvas Limited (registered in Hong Kong, China) that provides you with XMODhub game modifier and its services, referred to as "XMODhub" or "we" in this agreement.

1.4 XMODhub game modifier: refers to the game modifier software and related documents developed and operated by XMODhub.

1.5 XMODhub game modifier service: refers to the various services provided by XMODhub to you through the XMODhub game modifier.

1.6 You: also known as "player" or "user", refers to the natural person who is authorized to use XMODhub game modifier and its services.

1.7 Stand-alone game data: refers to the various data of the stand-alone game copy that you purchase and download and store in local files, as well as the various data generated during your playing of various stand-alone games, including but not limited to character data, virtual item data, etc.

1.8 AI assistant: refers to the artificial intelligence question and answer function module embedded in the XMODhub game modifier client, which provides users with automatic answer services for game strategies and other information through open source large model technology.

2. [XMODhub Game Modifier Account]

2.1 If you need to use the XMODhub game modifier service, you need to register an XMODhub game modifier account.

2.2 The XMODhub game modifier account is the identification and certificate that XMODhub authorizes you to log in and use XMODhub game modifier and related services in accordance with this agreement. Its ownership belongs to XMODhub. You only have the right to use your account in accordance with this Agreement. You may not provide your account to others for use in any way, including but not limited to transferring, leasing, borrowing, etc. to others for commercial use. Otherwise, any legal consequences and responsibilities arising therefrom will be borne by you, and XMODhub has the right to take measures against your account, including but not limited to warning, restricting or prohibiting the use of all or part of the account's functions, deleting the account and other related information, banning the account, or even canceling it. You will be responsible for all consequences.

2.3 You fully understand and agree that XMODhub has the right to verify whether the identity information provided by user registration is true and valid in accordance with the requirements of laws and regulations, and should actively take technical and management and other reasonable measures to ensure the safety and validity of user accounts; users are obliged to properly keep their account numbers and passwords, and use their account numbers and passwords correctly and safely. If it is discovered that your account may have abnormal circumstances or risks, XMODhub has the right to re-verify your account in accordance with relevant laws and regulations. If any party fails to fulfill the above obligations, causing loss of account password, account theft, etc. and causing damage to the civil rights of users and others, it shall bear the resulting legal liability.

2.4 Account security and risk control

2.4.1 You fully understand and agree that the XMODhub game modifier account is only for your own use. You may not provide your account to any third party in any form (including but not limited to sharing, lending, renting, transferring, selling, authorizing others to use, etc.), nor may you use other people's accounts to log in or use our services.

2.4.2 In order to protect the security of your account and prevent risks such as fraud, malicious sharing, account abuse, etc., you agree and authorize XMODhub to conduct security testing and risk assessment on your account login behavior. We may collect and analyze the following information: login device information (including device model, device identifier), login IP address, login geographical location (rough area inferred based on IP), login time, login frequency, device changes, network environment changes, etc. The collection and use of the above information will comply with the relevant provisions of the "XMODhub Game Modifier Privacy Protection Guidelines".

2.4.3 When the following abnormal situations occur in your account (including but not limited to): frequent logins from different devices or different IP addresses in a short period of time, abnormal changes in login location (across regions or countries), login behavior that is obviously inconsistent with your previous habits, signs of being used by multiple people or rotating use, suspicion of renting, lending, or transferring the account, or other situations that indicate that the account may be controlled by someone other than you or that there is a security risk, XMODhub has the right to take appropriate security measures based on the degree of risk, including but not limited to:

(1) Require you to perform additional security verification (such as SMS verification, identity information verification, etc.);

(2) Temporarily restrict or prohibit your account login;

(3) Restrict the use of some or all functions of the account;

(4) Freeze the account until the risk is eliminated;

(5) You are required to contact customer service for manual verification.

2.4.4 When restrictions are imposed on your account, you can apply to lift the restrictions through customer service. We will decide whether to lift the restriction based on the actual situation after verifying your identity. You shall be solely responsible for any losses caused by your account being restricted or used by others due to your own reasons (including but not limited to account sharing, lending, leasing, etc.).

2.5 If XMODhub provides the account cancellation function, if you need to cancel your XMODhub game modifier account, you can follow the account cancellation guidelines provided by XMODhub, and you should ensure that you meet the relevant account cancellation conditions announced by XMODhub.

At the same time, we also remind you that if you cancel your account, the value-added services under the game account will also be cleared. Accordingly, once you cancel your account, if there are still unused value-added services under the account, it will be regarded as your voluntary abandonment. XMODhub has the right to clear all data under the account, and you will be responsible for the consequences.

3. [Collection, use and protection of user information]

3.1 You agree and authorize XMODhub to collect your personal information for the purpose of performing this agreement. When you use the XMODhub game modifier service, XMODhub will collect information that you actively provide when using the service or that is generated due to the use of the service in accordance with the "XMODhub Game Modifier Privacy Protection Guidelines" to provide you with, optimize our services and protect the security of your account.

3.2 XMODhub respects and protects users’ personal information and privacy. XMODhub Game Modifier will comply with the provisions of the "XMODhub Game Modifier Privacy Protection Guidelines" regarding the collection, use and protection of users' personal information. If you have agreed to XMODhub processing your personal information in accordance with the aforementioned agreements or regulations and then withdraw your consent, according to legal provisions, your withdrawal of consent will not affect the effectiveness of the personal information processing activities that were carried out based on your consent before the withdrawal.

3.3 You understand and agree that in order to ensure the safe and stable operation of XMODhub game modifiers and to implement specific functions, XMODhub may share your necessary information with related parties or third-party partners. Please refer to the "Third-Party Information Sharing List" for specific sharing information. XMODhub will urge relevant third parties to handle your personal information in accordance with privacy protection guidelines and relevant agreements.

4. [XMODhub Game Modifier Service]

4.1 Subject to your compliance with this Agreement and relevant laws and regulations, XMODhub grants you a personal, non-transferable and non-exclusive license to use the XMODhub game modifier service. You may use XMODhub game modifier services only for non-commercial purposes, including:

(1) Receive, download, install, start, upgrade, log in, and run the XMODhub game modifier;

(2) Set a screen name, check user personal information, purchase and use value-added services, etc., and use chat functions and social sharing functions;

(3) Automatically detect and identify your locally installed stand-alone games (supports multiple platforms such as Steam and Epic), provides functions including but not limited to game modification, Mod loading, text translation, etc., and supports automatic update of modifiers closely following the game version.

(4) Use one or more other functions supported and allowed by XMODhub game modifier.

4.2 We solemnly remind you that XMODhub game modifier does not provide any services for online games.

4.3 You fully understand and agree: XMODhub game modifier service does not provide downloading or activation of any games, nor does it sell any game keys (CDKEY). Before using the XMODhub game modifier service, users should purchase and obtain the right to use the corresponding games themselves and ensure that the complete files of such games downloaded through legal channels are stored in local files. Otherwise, XMODhub Game Modifier will not be able to serve you.

4.4 Disclaimer for stand-alone game data modification: Users should strictly abide by the game rules set by stand-alone game developers and publishers and play in a civilized manner. Using the XMODhub game modifier service may cause changes to your stand-alone game data stored in local files. If you choose to use the XMODhub game modifier service, you agree to give XMODhub an irrevocable commitment and promise not to hold XMODhub responsible for any changes in stand-alone game data caused by your own use of the XMODhub game modifier service, including data recovery, compensation for losses, etc.

4.5 XMODhub's provision of XMODhub game modifier services to users is a commercial act. Users have the right to decide whether to pay the corresponding fees according to the charging items and charging standards determined by XMODhub to obtain the corresponding services. If you do not pay the corresponding fees according to the corresponding standards, you will not be able to obtain the corresponding services.

You understand and agree that: changes and adjustments to charging items or charging standards are a normal business practice, and you may not require XMODhub to compensate or compensate you due to changes or adjustments to charging items or charging standards.

4.6 AI assistant service

4.6.1 XMODhub provides an AI assistant function (hereinafter referred to as "AI Assistant") to provide users with information question and answer services such as game guides. The AI ​​assistant is technically supported by a large open source model deployed by XMODhub itself, and obtains relevant information by accessing a third-party search interface to assist in generating answers. You understand and agree that the content generated by the AI ​​assistant is automatically generated entirely based on artificial intelligence technology, and XMODhub does not make any express or implied warranty as to the accuracy, completeness, timeliness, reliability or applicability of the content generated by the AI ​​assistant.

4.6.2 Content Disclaimer. You fully understand and agree:

(1) AI large model technology has inherent limitations, including but not limited to the possibility of generating content that is not entirely accurate, incomplete, outdated or inconsistent with expectations, and the possibility of outputting responses that are inconsistent with your expectations;

(2) The game guide and other information generated by the AI assistant are for reference only and do not constitute any form of professional advice or basis for decision-making. You should independently decide whether to adopt relevant suggestions based on your own judgment, and bear all consequences;

(3) XMODhub does not assume any legal responsibility for any direct or indirect losses (including but not limited to loss of game data, account ban, damage to game experience, etc.) caused by your reliance on or use of AI assistant-generated content;

(4) The content generated by the AI assistant may involve information related to third-party games. XMODhub is not authorized by any game developer or publisher. You should make your own judgment and comply with the terms of service and usage rules of the relevant games.

4.6.3 Users’ obligations to comply with regulations. When using the AI ​​assistant, you should abide by laws, regulations, social ethics, and the relevant provisions of this agreement, and you are not allowed to use the AI ​​assistant to:

(1) Generate, disseminate, and store any content that violates the laws and regulations of the People's Republic of China or contains illegal and harmful information;

(2) Upload, input or submit any content that infringes upon the legitimate rights and interests of third parties (including but not limited to intellectual property rights, trade secrets, personal information rights, etc.);

(3) Use for any commercial purposes or any form of commercial exploitation.

4.6.4 Special reminder for game compliance. You understand and promise that when using the AI ​​assistant to obtain game guides and other information, you should abide by the official terms of service, user agreement and related rules of the game you are playing. The official terms and conditions of some games may prohibit or restrict the use of any third-party programs, automated tools, or auxiliary software to obtain in-game information or strategies. If your game account is subject to any penalties (including but not limited to account bans, data rollback, restricted functions, etc.) because the content generated by your use of the AI ​​assistant violates the official rules of the game, you shall bear the relevant responsibilities yourself, and XMODhub does not assume any responsibility.

4.6.5 Service Suspension and Restrictions. If you violate the AI ​​assistant usage specifications stipulated in this agreement, XMODhub has the right to take one or more of the following measures depending on the circumstances: issue a warning, suspend or permanently terminate your permission to use the AI ​​assistant function, freeze or cancel your account, and pursue your corresponding legal liability. You shall compensate XMODhub for any losses caused by your illegal use of the AI ​​assistant.

4.6.6 When you use the AI assistant, XMODhub will collect and use your query content, function usage logs and interaction data in accordance with the "XMODhub Game Modifier Privacy Protection Guidelines". Please note that please do not enter or upload any sensitive personal information (such as name, ID number, mobile phone number, bank account number, etc.), business secrets or other content that should not be disclosed.

5. [Software License]

5.1 Using the XMODhub game modifier service may require downloading and installing related software. You can obtain the software directly from the relevant website of the XMODhub game modifier, or from a third party authorized by XMODhub. If you obtain it from a third party not authorized by XMODhub, it will be deemed that you have not obtained authorization from XMODhub. XMODhub cannot guarantee that the modifier can be used normally and is not responsible for any losses caused to you.

5.2 After the new version of XMODhub game modifier software is released, the old version of the software may not be available. XMODhub does not guarantee that the old version of the software will continue to be available and provide corresponding customer service. Please check and download the latest version at any time.

6. [User Code of Conduct]

6.1 You fully understand and agree that you must be responsible for all your actions in using the XMODhub game modifier service, including any content you publish and any consequences arising therefrom.

6.2 In addition to using the XMODhub game modifier service in accordance with the provisions of this agreement, you shall not engage in any behavior that infringes upon the legitimate rights and interests of other third parties, including but not limited to:

(1) Reverse engineering, decompiling, and disassembling software;

(2) Use the software to conduct any activities that are illegal or infringe upon the rights of others;

(3) Interfering with or damaging the normal operation of the service.

7. [Intellectual Property Rights]

7.1 XMODhub is the intellectual property rights holder of XMODhub game modifier. All copyrights, trademark rights, patent rights, trade secrets and other intellectual property rights and other legitimate rights and interests of XMODhub game modifier are protected by the laws and regulations of the People's Republic of China and corresponding international treaties. You may not commercially use XMODhub game modifiers in any way without XMODhub's prior written consent.

7.2 If the XMODhub game modifier service involves third-party intellectual property rights, you should obtain valid authorization and consent according to the third party's requirements for such intellectual property rights before using the XMODhub game modifier service. Otherwise, XMODhub will refuse to provide services to you, and you will be solely responsible for violating corresponding requirements. XMODhub has the right to provide your information to third parties.

7.3 Intellectual property rights for content generated by AI assistants

7.3.1 The content generated by the AI assistant (hereinafter referred to as "AI generated content") is automatically generated through artificial intelligence technology. You may not use AI-generated content for commercial purposes beyond the scope of this agreement or for any form of independent development and utilization.

7.3.2 The intellectual property rights of the questions, uploaded texts and other content you input when using the AI assistant (hereinafter referred to as "user input content") are still owned by you or the relevant rights holders. You grant XMODhub a non-exclusive, free license valid during the provision of services to allow XMODhub to perform necessary processing of user input content (including but not limited to data cleaning, format conversion, storage, etc.) for the purpose of providing AI assistant services. XMODhub will not use user input content for model training or provide it to third parties, unless otherwise provided by laws and regulations or you have separately authorized it.

7.3.3 If you believe that AI-generated content infringes upon your legitimate rights and interests (including but not limited to copyright, trademark rights, reputation rights, etc.), you can submit a written notice to XMODhub through the complaint channel announced by XMODhub, and XMODhub will take necessary measures in accordance with the law after verification, including but not limited to deleting relevant content, disconnecting links, etc.

8. [Member Service Refund Rules]

8.1 The refund rules stipulated in this article apply to all membership services provided by the XMODhub platform (including but not limited to monthly, quarterly, annual, multi-year, permanent and other types of membership cards), regardless of membership length type.

8.2 If you apply for a refund while using membership services, the refundable fee will be calculated according to the following formula: Refundable fee = the actual membership service fee you paid − (original monthly card fee ÷ 30) × the number of days you have used it Among them:

• "Original price of monthly card" refers to the standard pricing of monthly membership services published by XMODhub (excluding any discounts, discounts or promotional prices).
• The "number of days used" is calculated from the date your membership service is activated to the date you submit your refund application.

If the result calculated according to the above formula is less than or equal to zero, you do not need to pay additional fees, and XMODhub will no longer refund any fees to you.

8.3 If you submit a refund application within seven (7) natural days after the membership service is activated, and XMODhub verifies that you have not actually used the membership service, XMODhub will refund you the actual membership service fee in full.

8.4 You can contact customer service through the XMODhub game modifier customer service interface to submit a refund application. After you complete the corresponding identity verification and refund confirmation process, XMODhub will refund your membership service fee within thirty (30) working days. The refund will be credited back to your payment account via the original route.

9. [Management rules for long-term inactive accounts]

9.1 In order to protect the security of your account and prevent risks such as account theft or abuse, if your account has not been logged in or used XMODhub services for one hundred and eighty (180) consecutive days, XMODhub has the right to temporarily freeze your account;

9.2 Before freezing measures are taken, XMODhub will send you a written notice seven (7) days before freezing via the contact information you provided when registering (including but not limited to email, mobile phone text messages, site messages, etc.) to remind you to log in to keep your account active. If you log in to your account within the aforementioned period, the freezing period will be recalculated.

9.3 After the account is frozen, you can

Contact XMODhub customer service to apply for unfreezing. After identity verification, customer service will handle the unfreezing process for you within forty-eight (48) hours.

9.4 Description of freezing properties

Account freezing is only a temporary restriction on your account login rights and does not mean account deletion or data clearing. After the account is unfrozen, your membership rights will be fully restored, and the membership validity period will not be extended or shortened due to the freezing period.

10. [Comply with local legal supervision]

10.1 When using XMODhub game modifier services, you should abide by relevant local laws and regulations, and respect local morals and customs. If your behavior violates local laws, regulations or moral customs, you shall be independently responsible for it.

10.2 You should avoid XMODhub being involved in political and public events due to the use of XMODhub game modifier services, otherwise XMODhub has the right to suspend or terminate your service.

11. [Jurisdiction and applicable law]

11.1 The place where this agreement is signed is the High-tech Zone, Chengdu City, Sichuan Province, the People's Republic of China.

11.2 The establishment, effectiveness, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of the Mainland China (excluding conflict of laws).

11.3 Any dispute or dispute arising out of this agreement (and/or related to this agreement) between you and XMODhub will first be resolved through friendly negotiation; if the negotiation fails, you agree to submit the dispute or controversy to the jurisdiction of the people's court with jurisdiction in the place where this agreement is signed.

11.4 The titles of all clauses in this Agreement are only for convenience of reading and have no actual meaning in themselves and cannot be used as a basis for interpreting the meaning of this Agreement.

11.5 No matter if part of the terms of this agreement is invalid for any reason, the remaining terms will still be valid and binding on all parties.

12. [Others]

12.1 XMODhub has the right to change the terms of this agreement when necessary. You can check the latest version of the agreement terms on the relevant pages of the XMODhub game modifier. After the terms of this agreement are changed, if you continue to use the XMODhub game modifier service, you will be deemed to have accepted the changed agreement. If you do not agree to the changes, you should stop using the service and cancel your account before the changes take effect.
