Xmodhub Terms of Service

This agreement is entered into by you and X Company, the provider of Xmodhub Service, and has contractual effect. Please read all the terms of this Agreement in detail. If you agree to this agreement, you can continue to use the services provided by Xmodhub. You click Agree, accept or next, or you register, use Xmodhub is deemed that you have read and agree to sign this Agreement. If you are under 18 years of age, please read this Agreement accompanied by your legal guardian, and you can only use the Xmodhub service after obtaining the consent of your legal guardian, and pay special attention to the terms of use for minors.

1.[Definition]

1.1 This Agreement: refers to the body of this Agreement, User Rules, Xmodhub Privacy Protection Guidelines and its revised version. The above content shall be an integral part of this Agreement once it is officially released.

1.2 User Rules: refers to announcements, tips and notices about Xmodhub published and revised by LARVAS LIMITEDfrom time to time.

1.3 Xmodhub Service Provider: refers to LARVAS LIMITEDCo., LTD., referred to as "X" or "We" in this Agreement, which provides Xmodhub and services to you.

1.4 Xmodhub: refers to the Game Modifier software operated by X.

1.5Xmodhub Services: refers to the services that X provides to you through Xmodhub.

1.6 You: also referred to as "Player" or "user", means a natural person who is authorized to use Xmodhub.

1.7 Single-player game data: refers to the data of the single-player game copies stored in local files purchased and downloaded by you and the data generated during your play of various single-player games, including but not limited to character data, virtual item data and other data.

2.[Xmodhub Account]

2.1 If you need to use Xmodhub, you need to register Xmodhub account.

2.2 The Xmodhub account is the identity and certificate authorized by X to user login and use Xmodhub and related services in accordance with this Agreement,and the ownership of the account belongs to X. You only have the right to use the account in accordance with this Agreement. You shall not provide the account to others for use in any way,including but not limited to, transfer, lease, loan etc. for commercial use. Otherwise, you shall be solely responsible for any legal consequences and liabilities arising therefrom, and X shall have the right to take measures against your account, including but not limited to warning, restricting or prohibiting the use of all or part of the functions of the account, deleting the account and other related information, blocking the account and canceling the account, and all consequences resulting therefrom shall be borne by you.

2.3 You fully understand and agree that X has the right to verify the authenticity and effectiveness of the identity information provided by the user registration according to laws and regulations, and shall actively take reasonable technical and management measures to ensure the security and effectiveness of the User account; The User has the obligation to properly keep its account and password,and use it correctly and safely. If you find that your account may have abnormal circumstances or risks, X has the right to re-check your account in accordance with relevant laws and regulations. If any party fails to fulfill the above obligations and causes damage to the civil rights of the user or others due to the loss of the account password or the theft of the account, it shall bear the legal liabilities arising therefrom.

2.4 If you need to cancel the account of Xmodhub, you can follow the account cancellation guidelines provided by X, and you should ensure that the relevant conditions for account cancellation published by X are met.

At the same time, it is also specially reminded that if you cancel your account, the value-added services under the account will also be deleted. According to this, once you cancel your account, if there are still unused value-added services under the account, you will be deemed to have voluntarily given up, and X has the right to delete all data under the account, and the consequences arising therefrom shall be borne by you.

3.[Collection, Use and Protection of User Information]

3.1 You agree and authorize X to collect your personal information for the purpose of performing this Agreement.In the process of your use of the Xmodhub Service, X will collect the information you proactively provide when using the Service or generated because of the use of the Service in accordance with the ways specified in the X Game Modifier Privacy Protection Guidelines, so as to provide and optimize our service to you and protect your account security.

3.2 X respects and protects the personal information and privacy of users. Xmodhub collection, use and protection of user personal information will follow the provisions of Xmodhub Privacy Protection Guidelines. If your withdrawal of consent will not affect the validity of the personal information processing activities that have been conducted before withdrawal.

4.[Xmodhub Service]

4.1 Subject to your compliance with this Agreement and relevant laws and regulations, X grants you a personal, non-transferable and non-exclusive license to use Xmodhub Service. You may only use Xmodhub Services for non-commercial purposes, including:

(1)to receive, download, install, launch, upgrade, login, and run Xmodhub;

(2)set up the network name, check the user's personal information,purchase and use value-added services, use the chat function and social sharing function, etc.;

(3)Use other functions supported and permitted by Xmodhub.

4.2 As a serious reminder, X Game Modifier does not provide any services for online games.You fully understand and agree that Xmodhub Service does not provide any game download, activation, nor sell. Before using Xmodhub Service, users should purchase and obtain the right to use the corresponding games by themselves and ensure that the complete files of such games downloaded through legal channels arestored in the local files. Otherwise, Xmodhub will not be able to provide you with services.

4.3 Single Game data modification Disclaimer promise: The usershall strictly abide by the game rules formulated by the developer of game. The use of the Xmodhub service may cause changes in your game data stored in local files. If you choose to use the Xmodhub Service, you agree to give X an irrevocable commitment that X will not be liable for any changes to your game data caused by your own use of the Xmodhub Service, including data recovery and compensation for damages.

4.4 X's provision of X Game Modifier service to users is a commercial act in itself, and users have the right to independently decide whether to pay the corresponding fees according to the fee items and fee standards determined by X itself in order to obtain the corresponding services. If you do not pay the corresponding fees according to the corresponding standards, you will not be able to obtain the corresponding services.

You acknowledge and agree that the change or adjustment of the fee standards is a normal business behavior, and you shall not require X to compensate for the change of the fee standards.

5.[Software License]

5.1 The use of X Game Modifier Service may require the download and installation of X Game Modifier software, which can be obtained directly from the website authorized by X. If you obtain X Game Modifier software from a third party that is not authorized by X, it will be deemed that you are not authorized by X, and X cannot guarantee the normal use of the modifier, and will not be responsible for the loss caused to you.

5.2 After a new version of X Game Modifier software is released, older versions of the software may not be available. X does not guarantee the continued availability of older versions of the software and the corresponding customer service, please check and download the latest version at anytime.

6.[User Code of Conduct]

6.1 You fully understand and agree that you are responsible for all your actions using the Xmodhub Service, including any content you post and any consequences arising therefrom.

6.2 Except that you can use Xmodhub Service in accordance with the provisions of this Agreement, you shall not engage in any behavior that infringes the legitimate rights and interests of other third parties.

7.[Intellectual Property Rights]

7.1 X is the intellectual property rights holder of X Game Modifier. All Copyrights, trademarks, patents, trade secrets and other intellectual property rights and other legitimate rights and interests of Xmodhub are protected by the laws and regulations of the People's Republic of China and the corresponding international treaties. X enjoys the above-mentioned intellectual property rights and legitimate rights and interests, except the rights that the relevant right holders should enjoy in accordance with the law. Without X's prior written consent, you may not use Xmodhub commercially in anyway.

7.2 If the Xmodhub Service involves intellectual property rights of third parties, you shall obtain valid authorization consent according to the requirements of such intellectual property rights of third parties before using the Xmodhub Service. Otherwise, X will refuse to provide the service to you, and you shall bear the responsibility for violating the corresponding requirements. X has the right to provide your information to the third party.

8.[Refunds]

8.1 Due to the unique nature of network services, once membership service is activated, Party A shall not request contract termination or refund without cause unless otherwise stipulated in this contract.​

8.2 Permanent Member Refund

8.2.1 The refund period for permanent members: The refund period for the game modifier for permanent members is 10 years, calculated from the date when you activate the permanent membership. If the refund period expires, you will be unable to apply for the cancellation of the permanent membership and request a refund from us.

8.2.2 The refund method for permanent members: You can click on "Cancel Service and Refund" . After completing the corresponding identity verification and refund confirmation procedures, we will refund the remaining permanent membership service fee to you 30 business days.

8.2.3 The refund amount for permanent members: The refund amount is calculated as the actual payment for the permanent membership service fee divided by (10 years × 365 days) multiplied by your remaining days (that is, 3650 days minus the number of days since you activated the permanent membership).

8.2.4 The validity of permanent membership: The refund period does not represent the validity period of the permanent membership. If you do not choose to cancel the service within the refund period, you can still continue to use the service of Permanent Members after the refund period.

8.3 Refund for "10-Year Membership"

8.3.1 Refund Period for "10-Year Membership": 10 years, starting from the date of your "Permanent Membership" activation. Once the refund period expires, you will no longer be eligible to cancel the "10-Year Membership" or request a refund.

8.3.2 Refund Method for "10-Year Membership": You may contact customer support via the XModHub Game Modifier service interface to "cancel the service and request a refund." After completing the necessary identity verification and refund confirmation process, we will refund the remaining balance of your "10-Year Membership" fee within 30 business days.

8.3.3 Refund Amount for "10-Year Membership": The amount refunded will be calculated as follows:

​**Total amount paid for "10-Year Membership" – (Number of days activated ÷ 30 days × 4)​∗∗​(i.e.,calculatedatarateof4 per month).

8.4 Refund for Other Memberships

8.4.1 Other memberships include: ​Exclusive VIP​ and ​VIP, but do not include memberships purchased through promotional campaign pages. Refund policies for campaign-based memberships are subject to the rules specified on the respective campaign page.

8.4.2 XModHub Game Modifier offers a ​3-day no-questions-asked refund policy, allowing users to request a refund for their first paid order within 3 days of successful payment. Refund requests must be submitted via customer support within this period; late requests will not be processed.

8.4.3 Refund method for other memberships: You may contact customer support through the Game Modifier service interface to ​​"cancel the service and request a refund."​​ After completing identity verification and refund confirmation, we will process your refund within ​30 business days.

8.4.4 A ​​$2 service fee​ will be deducted from the refund amount.

8.4.5 Once a ​first-order refund under the 3-day policy​ is processed, any remaining membership duration—regardless of how it was obtained—will be ​voided.

9.[Compliance with Local laws and Regulations]

9.1 In the process of using Xmodhub service, you shall abide by the relevant local laws and regulations, and respect the local morals and customs. If your behavior violates local laws and regulations or moral customs, you shall be independently responsible for this.

9.2 You should avoid involving X in political and public events by using X Game Modifier Service, otherwise X has the right to suspend or terminate your service.

10.[Jurisdiction and Application of Law]

10.1 This Agreement is signed in High-tech Zone, Chengdu, Sichuan, People's Republic of China.

10.2 The establishment, effectiveness, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of the Mainland of the People's Republic of China (excluding conflict Law).

10.3 Any dispute or dispute arising out of (and/or in connection with) this Agreement between you and X shall first be settled through friendly negotiation; If no agreement can be reached through negotiation, you agree to submit the dispute or dispute to the people's court with jurisdiction in the place where this Agreement is signed.

10.4 The titles of all clauses hereof are for convenience only and have no actual meaning and shall not be used as the basis for interpretation of the meaning hereof.

10.5 No matter the provisions hereof are partially invalid for whatever reason, the remaining provisions shall remain valid and binding upon the parties. X.

11[Other]

X reserves the right to change the terms of this Agreement if necessary, and you can check the latest version of the Terms of this Agreement on the relevant page of Xmodhub. If you continue to use the X Game Modifier Service after the terms of this Agreement are changed, you shall be deemed to have accepted the changed Agreement.
